A child has the right to a safe and healthy environment. If the child feels as though he's the victim of emotional abuse, he needs to report it to someone, like a school counselor or close adult relative or resource. They have rights, they are legally considered a minor. That means all of the amendments apply to them. They have a right to privacy, outside of a parent or guardian, the right to free speak. Yes this means, if you voice your opinion to a teacher THEY CAN NOT PUNISH YOU.
