Gol D. Roger was never actually caught by the marines, he turned himself in after he became the pirate king. The reason he turn himself in was because he was dying due to a disease he caught on the grand line and he wanted to go out like he lived most of his life with a great big bang. One could argue the whole purpose of giving himself up like that was to announce that he left all his treasure at the end of the grand line. Rather than his execution sending a warning like the marines hoped, it inspired a new 'golden age' of piracy.
