If it can be shown that it was faulty work, I don't know that there is a time limit. Some things may take years to show up, but it is still faulty work by the contractor. I'm sure the time limit will vary state to state.

Who should you go to as a subcontractor if the general contractor holds payments for extended amount of time and threatens contract termination if you stop work?

Sir or madam, Once a contract is agreed upon it cannot be altered. If your general contractor witholds payment, he/she is in breach of contract and you are entitled to sue for "Action upon debt". Bottom line - you earned the money, the court will give it to you, go see a lawyer. As for the threat to terminate your contract, the contract is alrteady void. Get a lawyer. Now.

Why do brake lights stay on when car is turned off?

I hope this helps, I would take a calculated guess that it is strictly a safety factor (in an emergancy on the highway if your foot is on the brake you are less likely to be rear ended) and if this is indead true, than it is wired to the battery independent of your starter switch If the brake lights are staying on even with your foot off the brake, it may be that the switch controlling the brake lights is broken. Beware; this can drain the battery.

Is workmens comp responsible for the 20 percent your insurance does not pay on doctors bills and prescriptions?

If you are talking about the med you get for workers comp pain they do pay the 100% (do not use your ins.)... (doctors visits as well) 100% If you have been injured on the job, Worker's Compensation is responsible for the WHOLE thing. It is not responsible for the 20% copay for your health insurance. It is illegal for you to file a work related claim on your personal insurance. Such claims must be covered by work comp per the Worker's Compensation Act. If your health insurance finds out, they can demand repayment.

The contractor is generally responsible for ensuring that the bill of quantities (BoQ) is accurate and reflects the work to be performed. Is an architect responsible for the quality of building work?

The quality of the "building work" or of the quality of the construction falls on the contractor for the project. The contractor might be the "project manager" (a general contractor) who hires all the other work done and insures all the contractors do their parts per the architectural requirements and the building codes. On smaller projects, the contractor might do all of the work himself. Or most of it, hiring out the rest and overseeing it. Large projects include engineers of all "flavors" who are supplied by the general contractor and also the subcontractors in the various specialty areas. But someone has to have the point and make the final decisions regarding the work and its quality, and the general or prime contractor has that task.

Is a person who hires a contractor usually liable for his torts?

Generally, a person who hires a contractor is not liable for the contractor's torts, as the contractor is considered an independent entity responsible for their own actions. However, there are exceptions, such as when the work involves inherently dangerous activities or if the hiring party retains control over the work. Additionally, if the hiring party negligently selects the contractor, they may also be held liable. Ultimately, liability can depend on the specific circumstances and jurisdiction.

Under an insurance claim I had my roof shingled. The shingles were faulty and blew off. My insurance company says the problem is mine to deal with shingle company. Whos problem is it?

Your Homeowners Insurance Policy provides coverage for the perils listed on your insurance policy. Covered perils are typically, Fire, Wind, Hail, falling objects, etc. Poor workmanship by a contractor is never a covered peril. If the shingles are blowing off the roof in light to moderate winds, it would initially appear that they were not installed properly. If you have an issue of poor workmanship from your chosen contractor, You should contact the roofing contractor who did the work. With your due diligence before hiring the contractor, you will have a copy of his or her Contractors General liability insurance policy which will cover the work performed. If you failed to verify that the contractor was properly insured, you may have no choice but to work with the contractor to have the faulty installation repaired or alternatively, hire a lawyer to file suit against the contractor and enforce your rights as a consumer. The first Hallmark of "Professionalism" in a contractor is that they are "insured" for the work they do and will readily provide you with a copy of their insurance policy on request prior to beginning work. If the contractor will not provide you with references and or verifiable proof of coverage, you should not allow the work to begin and look for another contractor. It is always a good practice before you hire a contractor, to check on their references so you can know if other customers have been satisfied with their work. If your state has a contractors licensing scheme ( Many do not ), you should also make sure they are licensed for the work being offered. And last but not least, you should "Always, Always" make sure the contractor is properly insured. In the event the work performed is faulty or substandard you will be able to file a claim against the contractors insurance to pay for any additional costs of bringing the work up to code.Bear in mind that the your homeowners insurance will only pay for the repair job once. It's up to you to choose a reputable contractor to perform the work. The insurer is not liable for our poor choice of contractors and does not pay for damages that result from perils ( poor quality or workmanship ) not listed on the policy.AnswerIf the shingles were faulty, you should let the roofing company that installed the shingles know that there is a problem. The installers should notify the shingle manufacturer, whose responsibility it is to warranty their product against defect. The insurance company should not be responsible for faulty shingles, only the damage caused by a leaking roof ( and after the initial claim, you will have to prove that you took steps to prevent further damage).

If hired a contractor to update electrical wiring in your house. After the work the outlets in your kitchen all shorted out. The contractor refused to return to do the work without additional payment?

In this situation, it's essential to document the issue, including any communications with the contractor and evidence of the faulty work. You should first attempt to resolve the matter amicably by discussing the problem with the contractor and referencing your original agreement. If they refuse to rectify the issue, consider filing a complaint with your local licensing board or seeking legal advice to explore your options for recourse, such as mediation or small claims court.
