Which state refused to recognize the Cherokee people as a separate nation with their own laws?

Oklahoma

How did John Ross argue against the removal of the Cherokees?

He lobbied against the passage of the Indian Removal Act and gained the support of some prominent Whigs, but it passed. He filed suit in the Supreme Court against the state of Georgia in protest of state laws that punished the Cherokee. The Court ruled that state laws did not apply to Indian affairs but that did not help the Cherokee where federal law was concerned. He tried to get a treaty approved that would delay the removal of the Cherokee but another faction in the Cherokee nation signed a different treaty that agreed to the removal.

Where are the Cherokee from?

The Cherokee are from lands that are now part of the USA. They were originaly a powerful tribe in the region of North and South Carolina and moved successfully to adopt many elements of the surrounding white culture following the American Revolution. During the Presidency of Andrew Jackson, they were forced to give up their lands and relocate to what is now the state of Oklahoma, but was then called the Indian Territory. Cherokee lawyers appealed the order to mive through the courts and the US Supreme Court foud in their favor, but Jackson refused to comply with their decision. The move from North Carolina to the Indian Territory is called the Trail of Tears because so many died along the way due to the haste required and the poor support offered by government officials. Some Cherokee ressisted the relocation, took to the hills, and remained in the Carolinas. As a result, the Cherokee now exist as two Tribes, the Eastern Cherokee and the Western Cherokee.

How did the Cherokee attempt to retain their land?

They filed suit against the State of Georgia, and when the case was decided against them they appealed up to the Supreme Court. In 1837, the Supreme Court decided in their favor, but President Andrew Jackson refused to recognize or enforce the decision and had them rounded up and force marched to Oklahoma. Some Cherokee remained behind, other (like my greatgrandmother's people) escaped along the way and were helped by locals to return to North Carolina.

Why were the Cherokee the only ones who had refused to leave the state of Georgia?

The Cherokee were the only tribe that refused to leave Georgia due to their established agricultural society, legal recognition, and attempts to assimilate into European-American culture, including adopting a written language and creating a constitution.
