No one is "caught" going to Cuba. To get there you would have to take a special flight or ship and have a passport. Without the proper passport you can't get on the plane or ship. As it stands today only particular professionals can visit the island. If you went on your own without the proper paperwork the Cuban government would arrest you. Personally, I wouldn't want to see inside a Cuban prison.
