Yes, she could be charged with a number of crimes, including child abuse, child neglect, and corruption of a minor. Parent's can't give permission for someone to break a law. Chances are not high that they would be charged, but you can bet that that 23-year-old is going to be in trouble!
You would have to check your local laws concerning pertinent details but what actually took place (from what is gathered by your question) was between the 12yr and the 23yr. The sister didn't give the permission for sexual intercourse nor did she have anything to do with getting her pregnant what took place was strictly between the 2 involved.
With that said the blame can't be shifted for anothers indiscretion - what is done is done now unfortunately it now lies on how you will deal with this poor 12yr olds future. She needs support and empathy not ridicule and judgement. Besides what purpose would it serve to "charge" the sister for saying you could go out - not knowing all the details the one that should be charged is the 23yrs old for statutory rape.
