There are no 40 amp service distributions in North America. The range circuit has to be a branch circuit from a larger size distribution panel. Most distribution panels installed today are 200 amps. Pre wiring of new homes today use a 3 conductor # 8 cable, connected to a two pole 40 amp breaker for connection to electric ranges.
