Well, it wasn't Shakespeare and it wasn't really stealing. James Burbage had constructed the Theatre on land rented from a Giles Allen. In 1595 he got into a dispute with the landlord, who locked Burbage's acting company (of which Shakespeare and Burbage's sons Richard and Cuthbert were members) out of their own theatre. They had to play at the Curtain theatre down the road.

James Burbage died and Richard and Cuthbert inherited the theatre to which they were not allowed access. Eventually, in 1599, they said, "Enough of this!" and when the landlord was away, they entered the property and dismantled the building, shipping the timbers south across the river to Southwark, on the other side of the Thames from London, and already the home of several theatres. But although they had most of the framing timbers they needed, they still needed money to thatch the roof, to install lath and plaster and to paint. In order to raise the money, they called upon six of their fellow actors from the Lord Chamberlain's Men to pony up in exchange for shares in the new theatre and its profits. One of those six men was William Shakespeare. They called the new theatre the Globe.

Whether Shakespeare lent his back to the difficult job of moving the timbers, we don't know, but he was certainly not in charge of the operation (that would be the Burbages' carpenter Peter Street). If he was there he was a grunt. And since Burbage built the original building in the first place at his own cost, and he certainly did not intend to give a free benefit to his landlord by improving his land, the strong legal argument suggested that the building belonged to the Burbages and not to the landlord anyway, so it wasn't stealing. The landlord, Giles Allen, sued Street over the issue, and the court held that Street and the Lord Chamberlains' Men had the right to take the building.
