In the United States, it is only legal in the state of Nevada in specified areas within eleven counties. Nevada has very strict regulations pertaining to brothels and additional laws which make prostitution illegal outside of licensed brothels. It is legal because many people want it to be legal. It is legal because many people believe people should have the freedom to do what they want to do to their own bodies. Consensual sex without one person paying the other for it is legal so why not allow a person to pay for or accept payment for it as well? In many Western countries the following are severely restricted or banned:

  • Running a brothel
  • Organizing prostitution
  • Advertising/soliciting sex for money
  • 'Living on immoral earnings'

Prostitution as such is not generally banned as there are problems of definition. For example, some men give female 'friends' lavish presents but not cash.

An escort, working on her own, who offers sex for cash as well, can often stay in the clear.
