Rules of inheritance are complicated at any time and in any place. This includes England at around 1600. In the 1530s legislation had been passed which enabled the making of wills which were instructions as to the disposition of property upon death. Wills could dispose of both real property (land) and personal property (everything else).

Where there was no will, a married man's real property went to the eldest son (as well as titles and other similar rights) and the personal property to the widow. All of a married woman's property went to the widower.

However, the estate of a married man was charged with payment of dower, a provision for the support of the widow equal to one-third of the real property, whether he made a will or not. Dower could be replaced by the provisions of a prenuptual agreement. Payments under such an agreement were called a jointure.
