Electromagnetic energy is just a name used to describe various forms of energy that are related to electricity & magnetism. So electromagnetic energy might include the kinetic energy of moving charges, or the potential energy between charges or magnets or it might refer to the energy of radiation, which is neither kinetic or potential energy.

This is true for the electrical field caused by the charges.

it is not true for the magnetical field: as the magnetical field is proportional to

velocity v and therefore its energy is proportional to v² it is obvious that

it must be proportional to kinetic energy (1/2 mv²)!

So the answer should read:

the relative position of electrical charges causes potential energy,

whereas the magnetical field of a charge in relative motion is associated with

kinetic energy.

Electromagnetic energy is potential energy. All potential energy is the energy due to the position of something in a potential field. "Traditional" potential energy is that given to a mass by raising it. What is really happening is that the mass's position is being changed in the gravitational potential field. The gravitational potential field (gravity) is caused by the presence of any mass in space. Some particles are charged. Like gravity, charge is a fundamental property of the universe. Just as mass causes a gravity field, charge causes an electromagnetic field. Electromagnetic energy is the energy that a particle has due to the field produced by another, nearby charged particle.

Both. In forming circuit theory in the 1860s James Clerk Maxwell treated electrostatic energy as potential and magentic energy as kinetic.
