The American Government is based off of the Roman Empire's government. the expression "do what the Romans do" is very appropriate for how many things the American Government has adopted as well.
Americans had understandably soured on the idea of a strong central government after living under British rule. The American Revolution was fought to gain freedom and independence.
There were many things that the American government did to limit the spread of communism. For example, the government put the words "under God" into the pledge of allegiance and denied atheists from serving in government positions.
You would have to specify which government, what level of government, and what level of agency. "the government" and "criminal justice system" could mean any number of different things.

It would be a stretch to say so. Capitalism is an economic system and not a form of government. Both America's republic government and capitalism allow each individual American to worship and ministry in whatever religion they chose to follow. Jesus said in Matthew 22:21 "Render therefore unto Caesar the things which are Caesar's; and unto God the things that are God's."
