Many criminals do not have a conscience, which means that they don't feel badly at all when they hurt or kill someone, or do illegal things. They also are not motivated to do good things. That does not mean that they are incapable of choosing what they will do and what they will not do.

There is a deterministic argument that says that nobody has free will, really. We are wired to make the choices we make, and little if anything can induce us to behave otherwise. Either way, the social order requires that for the greater good people who do harm to others have to be restricted.
