Even this criteria can vary from "doesn't know and is searching for an aswer" to "doesn't know and doesn't care because the answer is unimportant"

There aren't any specific duties of an agnostic. It's kind of like asking what the duties of a left-handed person are. Certainly many agnostics have beliefs that they hold impose duties on them. But they aren't specifically agnostic beliefs.
Depends if this person doesn't accept any religion, if not then they are either atheist or agnostic. Athiest's do not accept religion and believe in other theory's but people who are agnostic are basically in-between they are not too sure.
