No same-sex couples have legally married in Fulton county because same-sex marriage is currently prohibited in Ohio by statute and amendment to the State Constitution. On April 14, 2014, however, a United States District Court Judge ruled that the state of Ohio must recognize same-sex marriages performed in other states. That decision was simultaneously stayed pending the outcome of an appeal, with the exception that Ohio must immediately recognize same-sex marriages for the purpose of issuing birth certificates showing plaintiffs as parents of their own child. On May 9, 2014, the Ohio Attorney General appealed that decision to the United States Court of Appeals for the 6th District. On December 23, 2013, a different federal judge ordered the state of Ohio to recognize out-of-state same-sex marriages for the purpose of listing a spouse on a death certificate. That decision is also currently under appeal (but not stayed) by the 6th Circuit.
