This is a complicated area of property ownership. Planned Unit Developments are defined as mixed use residential developments of single family dwellings in conjunction with rental, condominium, cooperative or town house properties. A PUD must conform with certain requirements such as a homeowners association that holds title to the common areas, mandatory membership of all unit owners, the right of all to participate by vote and lien supported assessments to handle operating costs.

The owners of a lot within a PUD own the lot which has been conveyed to them-as shown in the recorded subdivision plan-and the structure and improvements on that lot. In addition, they receive rights and easements to use in common areas owned by a homeowner's association-of which the individual lot owners are members.

Any unit or lot owner could review their deed to determine what they own. To determine the arrangement in any particular community you would need to access a title examination for that PUD to determine what interest is owned by the individual unit or lot owners. Generally, once the units and/or lots have been conveyed the remaining common areas, including passive recreation buffer areas, are conveyed by the developer directly to the homeowners association, which then allows use by all unit owners according to the rules and regulations of the development.
