ONLY if they were included as income on a paycheck somehow. YOU CAN NOT DEDUCT MONEY YOU DIDN'T MAKE. There is a lot of money you didn't make. The money is NOT taxable, not tax deductible. (If you paid tax on it and didn't receive it, then you could deduct it...basically because you overpaid, not because you under-earned!

What should you claim as deductions on your W-2 form?

Form W-2 is Wage and Tax Statement. It's an IRS form that employers are required to provide/send to their employees for the employees to use in filing their tax returns. You don't claim deductions with your W-2 form.

Form W-4 is Employee's Withholding Allowance. It's an IRS form that your employer has you fill out when you're hired. Your employer calculates withholdings from your earnings based upon the filing status and number of exemptions that you claim on Form W-4. The more exemptions you claim, the less will be withheld from your earnings.

A single person can claim one personal exemption plus an additional exemption if only having one job. If you (or your spouse) have more than one job, then you might want to claim less exemptions to make sure that enough is withheld from your earnings. You can claim exemptions for dependents, if any.

If you have a significant amount of unearned income (interest, dividends, capital gains, etc.) or self-employment income, claim fewer exemptions. If you're expecting certain credits (earned income, child and dependent care, etc.), claim more exemptions.

Also included with Form W-4 is a Personal Allowances Worksheet plus Deductions and Adjustments Worksheet and Two-Earners/Multiple Jobs Worksheet. These Worksheets all help you determine the number of allowable exemptions for Form W-4.

You can finetune your withholding with the IRS withholding calculator onlne at www.irs.gov. Select Too Much or Too Little Tax Withheld in the Special Interest Section in the middle column.

For more information, go online to www.irs.gov/taxtopics. Select Topic 753 (Form W-4 Employee's Withholding Allowance Certificate).

Also, for Publication 919 (How do I Adjust my Tax Withholding?), go to www.irs.gov/formspubs. Select Publication Number. Type 919 in the Find bar.

If your dependents file tax returns can you still claim them?

Yes. Being claimed as a dependent doesn't prevent the dependent from filing a return. That also doesn't prevent you from still claiming them on your own return. The IRS gives guidelines for determining whether dependents are required to file tax returns. Also, even though dependents might not be required to file, they should file if tax was withheld in order to receive a refund of that tax.

When do all tax forms legally need to be given out?

Income information forms generally are required to be provided/sent to the recipients by January 31st. If January 31st falls on a weekend, the deadline is extended to the next business day. The deadline for 2008 information forms is February 2, 2009 (February 1, 2010 for 2009 returns). These information forms include Form W-2 (Wage and Tax Statement) as well as the 1099 series, etc.

Can a dependent file own tax return if claimed on parents' tax return?

Yes. The IRS has income guidelines for determining whether dependents are required to file tax returns. Generally, for 2008 income, dependents are required to file if single under 65 with earned income of over $5,450 ($5,700 for 2009) or if married under 65 with earned income of over $6,800 ($7,100 for 2008). Even if your income is below the level requiring you to file, you should file if income tax was withheld from your earnings in order to receive a refund of that tax.

When is the deadline for taxes if you do not owe?

Generally you have three years in which to file a tax return for a refund. After three years, the IRS refund statute doesn't allow for issuing a refund. The three years starts on the due date of the original return for the particular tax year.

If you are a dependent can you still file taxes?

Yes. A dependent can file a tax return for several reasons.

One, they're required to file because of their income. For example, Single/Married Filing Jointly dependents under age 65 are required to file if any of the following apply.

Your unearned income (interest and ordinary dividends, capital gain distributions, etc.) is over $900.00 for 2008 ($950.00 for 2009).

Your earned income was over $5,450.00 for 2008 ($5,700.00 for 2009).

Your gross income (earned plus unearned income) was more than the larger of $900.00 ($950.00 for 2009) or your earned income up to $5,150.00 ($5,400.00 for 2009) plus $300.00.

Two, if they're not required to file, they still can file for a refund of tax that was withheld from their earnings.

How do you claim mileage donated to a non profit?

Charitable contributions are deductible on Schedule A (Itemized Deductions). The amount is entered on Line 17 (Other than by cash or check) in Gifts to Charity section.

There are two methods for mileage deduction. One, deduct unreimbursed out-of-pocket expenses, such as the costs of gas and oil directly related to travel to and from the charitable organization. Certain expenses are not deductible: general repair and maintenance, depreciation, registration fees, tires, insurance. Two, deduct actual mileage at the rate of 14 cents per mile.

Parking fees and tolls are deductible under both methods.

For more information, go to www.irs.gov/formspubs for Publication 526 (Charitable Contributions).

The custodial parent can claim the child as a Qualifying Child for (1) Head of Household filing status, (2) Credit for Child and Dependent Care expenses, and (3) Earned Income Credit.

How do you receive your W-2 forms when your company mailed them to the wrong address?

Form W-2 is Wage and Tax Statement. The IRS requires employers to provide/send them to employees by January 31st. If January 31st falls on a weekend, then the deadline is extended to the next business day. If you haven't received your W-2s for whatever reason by then, contact your employer.

If your employer hasn't cooperated in reissuing your W-2s by mid-February, then contact the IRS at 1-800-829-1040. The IRS will write to your employer requesting that the W-2s be provided to you. The IRS also will mail to you Form 4852(Substitute for Form W-2 or Form 1099-R). If your employer hasn't provided the W-2s by the time you need to file your return, then fill out Form 4852, attach it to your return and go ahead and file your return in that way.

Is there a deadline as to when you should receive a 1090 tax form showing taxable earnings?

There is no IRS Form 1090. Form 1099-MISC is Miscellaneous Income. When the Payer (person/business who paid you) sends you a Form 1099-MISC, they consider you as self-employed. That's why they're sending you a Form 1099-MISC, not a Form W-2 (Wage and Tax Statement).

Generally, payers and employers are required to provide/send 1099 forms and W-2 forms by January 31st. If January 31st falls on a weekend, the deadline is extended to the next business day. Form 1099 and Form W-2 are due by February 2, 2009 for 2008 income. They're due by February 1, 2010 for 2009 income.

What do you do if you left off a W-2 form from a second employer on your tax return?

You need to file an amended return if you omitted a W-2 form from your original return. Form 1040X is Amended U.S. Individual Income Tax Return. You should file your amended return as soon as you discover any omissions or corrections.

Be sure to note where to mail your Form 1040X in the Where To File page of Instructions for Form 1040X. Amended forms don't necessarily go to the same Internal Revenue Service Center where you filed your original return.
