The iPod touch cannot update past iOS 3. If it could, it would be really slow and give you anxiety anyway.
You need the restriction code.
It seems as though you've run into the major setback when jailbreaking an iPod Touch - if you don't do it right, you'll ruin it. It seems like you ruined the iPod Touch. Try taking it to an Apple Genius at your local Apple Store.
It COULD... if Mozilla would develop a stripped-down version, like the stripped-down (not Flash-capable) version of Safari on the iPhone and iPod Touch. THEN they'd have to get it past Steve Jobs. THAT is the RUB!
First, you have to plug your new Ipod touch into your computer. Next,(If you haven't already), download Itunes. Once your Ipod is plugged into your computer and Itunes is up and running, on the side it will show devices. Click on that. After you click on that, it should say, "Welcome to your new Ipod." After you have entered in your information, you should be good to go!
The past tense of touch is touched.
