Well I have a basic phone a Nokia 2730. My brother sent me large picture messages (Multimedia) from his expensive new phone. For me to view them on my phone, I had to (in the message) go into: Options > Show contents > Open To view them.
How are you accesssing them? If you are simply reading them over their shoulder, or witnessing them while in a chatroom, no. However, if you are 'hacking' into them you are probably breaking SOME law or regulation.
