Some people feel that what an employee does during their own time is their own business, while others feel that poor judgement on part of the employee would reflect poorly on the organization for which they work, even if during off-hours. If the employer gained access legitimately, it is probably legal, while if they gained access through someone else's account, it is probably not legal. Of course, it depends on the state/province and country the employer and employee is in. Consult a local lawyer for a professional opinion.
