If the drain stops shy of the sidewalk, and the water "just so happens to fall onto the sidewalk", then it's legal. You cannot, however, purposely install the drain over a public sidewalk. In fact, most of the time, there is aneasement that prevents you from installing ANYTHING within a certain distance of your property line. Most of the times, it's either a set distance, like 20', or if you're building a building, than it has to be installed as far away from the property as it is tall. The same may go for a drain or something similar. Check with your local Homeowner's Group or whatever...
