You have to unlock it first. The whole idea of this type of lock or passcode is that nobody who doesn't know the secret code can access the phone.
Click settings and choose phone settings or go on your photos and go onto options, use as, then click wallpaper.

Update to iOS 4.0.1, then go to wallpaper and change lock screen wallpaper and home screen wallpaper. It wont work for iPod touch 3g and under and iPhone 3g and under because apparently it will slow it down all the new features.
