The people who try to sneak into US territory are committing a simple trespassing violation, for which a death sentence seems too harsh and which violates most human rights treaties in the world for which the US has been part of. Besides, such actions would be considered as "state terrorism" as many Americans too would be killed or maimed by such devices.
To put this in perspective, lets assume your neighbor next door tries to prevent any trespassing into his lawn by removing the old wooden fence and instead puts some landmines in place. This opens two questions: what if a child from his own family steps on such landmines? or what if another neighbor mistakenly steps on such devices, killing him? Your neighbor would most surely be charged with murder in first degree.
