No, it's not illegal unless you preform the following activities.

1. Copy the emulator on to a disc and sell it.

2. Download ROMS you don't own. To own it you have to have on the Real N64 or the Wii ( virtual Console)

Of course any other use is perfectly fine at least this is all I know.
