Spain holds a national election every 4 years. All members of both houses are elected at that time. Then the King consults with the representatives of all the political parties represented in the Congreso de Deputados (the lower house of parliament). They nominate one member for the post of Presidente del Gobierno. The King then presents that name to the Congress of Deputies.

So far the person selected to be Presidente has been the leader of the majority party, or or the leader of a majority coalition. There is no statutory requirement for this selection.

The person so selected then presents his plan of action for the new government to the Congress of Deputies. If his proposal is given a vote of confidence he/she is then sworn in as President. He/she then forms the rest of the government.
