i have had a mot and been told by the mot bay man that if a leak in the exhaust doesn't leak then he may give an advise to correct the problem , if the exhaust isn't leaking fumes then the mot man should pass it as it legal to the mot book, if its not leaking and he fails it ask for an appeal form as this normally does the trick as they don't want the hassle, and tell the mot man you will replace that section of the exhaust asap and it will no longer be an issue this will normally get the car through mot for now :)
