However if you intend to use it for any commercial purpose or you intend to posting it to a website (such as you tube) where they may be recognized you must obtain the release of all the persons that appear in the shots.
It is perfectly legal. so long as you are truly in public. The mall is NOT public, its private property and most have a "no photography" rule which nobody pays any attention to these days. But you have no RIGHT to be in the mall photographing anything, unless you're renting a studio in there. But people on public property can be photographed with impunity, legally speaking, which is not to say they will not take exception and retaliate and open up additional, different legal issues.
