Marijuana is illegal under US Federal Law, so technically it's not "legal" anywhere in the US. The various states that have "legalized" marijuana have basically said just said that it's not illegal under STATE law.

This leaves it in a sort of legal grey area where local and state police may (or may not) be under orders to officially ignore marijuana, but if federal officials get bored and/or are gunning for you for some other reason, you could still potentially wind up in prison serving a sentence for possession of a Schedule I controlled substance. It may not be terribly likely (federal agents have plenty of stuff to keep them busy, so they're probably not going to waste a lot of time trying to bust some guy for having a joint or two), but it is theoretically possible.

That said, California in an egregious but not-really-all-that-surprising display of hypocrisy actually decriminalized only "medicinal" marijuana, meaning it's not precisely non-illegal even under state law; you have to fall into a certain category before state law permits marijuana possession. Other states have gone much further.
