42 Pa.C.S. § 9714

Reads:

"Conviction for a second or subsequent crime

of violence. A crime of violence includes

any of the following offenses: murder of the

third degree; voluntary manslaughter;

aggravated assault (F1); rape; involuntary

deviate sexual intercourse; aggravated

indecent assault; incest; sexual assault; arson

(F1); kidnapping; burglary of a structure

adapted for overnight accommodations in

which at the time of the offense any person

is present; robbery (F1); robbery of a motor

vehicle; or an inchoate to murder or any of

the listed offenses.

(1) If at the time of the commission of the

current offense the person has previously

been convicted of a crime of violence, a

minimum sentence of at least ten years must

be imposed.

(2) If at the time of the conviction the person

has previously been convicted of a crime of

violence and has not rebutted the

presumption of high risk dangerous

offender, a minimum sentence of at least ten

years must be imposed.

(2) (3) If at the time of the commission of

the current offense the person has previously

been convicted of two or more crimes of

violence, a minimum sentence of at least

twenty-five years must be imposed. The

court may sentence the person to life

imprisonment without parole. Effective
