To explain, there are four different types of sexual offense where age is a determining factor. These sexual offenses do not apply when both parties are 16 and up, OR if they are within 4 years of age of each other.

The two exceptions are school employees having sex with students, in which case it is a crime if the person is under 18, rather than 16. The other is for soliciting a prostitute. If the prostitute being solicited is under 18 (or is a police officer posing as a minor), it is a crime called "sexual solicitation of a minor."
