Per the San Jose building department on 4-14-2014, the minimum setback is 25 feet for R-1-8 residential zoned homes. You can ask for an exception if the average of the houses on your street have smaller setbacks. For example, if the average of all the houses on your side of the street is only 15 feet, then you can request an exemption that allows you to build out to the 15 foot setback line.

They confirmed with me that the average setback requirement does not work against you if the average on your street is higher. In other words, if the houses on your street are 40 feet back on average, you can still build out to the 25 foot setback.
