Are post-dated checks issuing allowed by the State law in Greece or it is forbidden? Tks for the answer. Massimo
In the United States, post-dated checks are generally legal, but banks are not required to honor them. If a post-dated check is deposited before the date written on it, the bank may process it unless the account holder has provided the bank with written notice not to do so. It is recommended to communicate with the payee and your bank to ensure the check is deposited on the intended date.
In Louisiana, post-dated checks are generally considered valid, but they may not be enforceable until the date on the check. The issuer of the check should communicate its post-dated nature to the recipient, as banks are not obligated to honor a post-dated check until the date specified. If a check is cashed before its intended date, the issuer may have grounds to dispute the transaction. However, it's advisable for individuals to consult legal counsel for specific situations or disputes involving post-dated checks.
If someone writes 4 bad checks that were post dated what charges would they be facing in this situation.
Most checks become stale dated -- which means they cannot be cashed -- after 6 months, though some checks last for a year (business checks). Some checks may have an even shorter life (the check would say "Void after ________"). If your check is stale dated, it is likely your bank will refuse it or, if they accept it, that the drawee bank will return it against your account. You should request a new, currently dated check from the original maker.
Actually nothing. It is the responsibility of the person who received the cheque to deposit and encash it before the cheque becomes stale dated.
debit to cash and credit to accounts receivables
Most banks and check cashing services will not cash "post-dated" checks until the date comes due on the date of the check. However, legally, some jurisdictions have laws that allow the negotiation of post-dated checks under the premise that the payee should be able to collect immediately when given a check.
Yes, it is possible to have a post-dated manager's check, but it depends on the policies of the issuing bank. While manager's checks are typically considered guaranteed funds, banks may not honor a check that is post-dated. It's advisable to check with the bank to understand their specific rules regarding post-dating manager's checks.
! Banks have no responsibility to review the date on a check to determine if it should be deposited, paid, refused or rejected (this is in Rules and Regulations provided when an account is opened); On a stale dated check, ifcustomer doesn't want check paid, they should place stop payment on it. This also applies to post dated checks. According the the UCC, a bank can refuse a stale dated or posted check. It is at the discretion of the financial institution.
The date the check can be cashed . For example I wrote ( 5 ) post dated checks last winter to a company that handles my snow removal of my residence Each check was dated the last day of the month . ( November / December / January / February / and March ) That way the company could cash the checks at the end of each month if I went somewhere warmer for the winter
