A "stay" can only be issued by a judge. If a stay is desired by a participant in the case, their only option is to present a motion to the judge requesting it. The judge will consider and rule on your motion either granting it, or not.

There is usually a "stay" on the lower court order, preventing any action from being taken until the US Supreme Court rules.If the case has simply been petitioned to the Supreme Court for a writ of certiorari, and has not (yet) been accepted for review, the lower court must agree to the stay, or the US Supreme Court must override their refusal and grant an emergency order.
Stayed: If the charge is "stayed" by the judge, this means the present proceedings are suspended. It is not a finding of innocence, simply a stopping of the prosecution at a particular point. The proceedings can be started again in the future if certain events occur (for example, new evidence is found).
A Supreme Court justice must remain above reproach in his or her personal life. Justices can be impeached if they are guilty of moral turpitude or crimes of law.
