(Presuming it is a government insured, guaranteed or otherwise involved loan - which are therefore allowed to directly offset any money the gov't would pay you otherwise). Your filing status and amount of refund make no difference to the creditors right (in this case the Gov't), to offset the amount you owe, up to the amount you owe. They also have the right to use other means of collection, (like garnishment). You may find that contacting them and acknowleging your obligation to pay (no reason to stress that you now understand they will eventually collect it all from you, adding interest and fee's along the way - every opportunity they have through your life)...and arranging a payment schedule...which if you adhere to will mean they will stop alternative collection methods (and likely save you fee's and such they would add), is a reasonable thing to do. Gotta pay it off somehow anyway, tey ain't going away and you can't even clear it through bankruptcy (or death - they will take it from your estate before any heirs get anything). A little contriteness when doing this doesn't hurt.

Husband dies leaves unpaid income taxes filing jointly is wife responsible if there is no estate in Indiana?

Joint filers are both responsible for the entire tax bill. If the unpaid taxes are from a year that the couple filed jointly, the wife is fully responsible for any unpaid taxes unless she can meet the qualifications for innocent spouse relief. After the filing deadline, a joint return cannot be amended to separate returns. If there are unpaid taxes from 2008, the wife can still file a separate return for 2008. If a joint return has been filed for 2008, they have until April 15, 2009 to amend.
