Direct discrimination in adult social care can occur when a service provider treats an individual unfairly based on characteristics such as age, gender, race, disability, or sexual orientation. For example, if a caregiver denies a service or provides lower-quality care to a client solely because of their disability, it constitutes direct discrimination. This unfair treatment undermines the individual's dignity and access to necessary support, ultimately affecting their well-being and quality of life. Efforts must be made to ensure equitable treatment for all clients in social care settings.
There are two law that provide job security during your leave for disability: the FMLA provides twelve weeks of unpaid leave for your disability. NJ has a separate law, but it provides leave for you to care for a sick family member - not your own disability. Your employer does not have to hold your job open if FMLA does not apply, or if your leave extends beyond 12 weeks.
Disability insurance covers any impairment that is previously unknown to the beneficiary. However, the beneficiary only provides partial wage replacement to workers who are unable to work due to their disability.
You would need to follow-up with your physician to determine whether you need to go out on disability. If your physician places you on disability, and provides the information to support that, then you may be eligible for disability benefits if you have them.
