The House of Representatives had to decide the election in certain instances, such as the 1824 presidential election, because no candidate received a majority of the electoral votes. According to the 12th Amendment of the U.S. Constitution, when this occurs, the House selects the President from the top three candidates. This process ensures that the election outcome can still be determined democratically, even when the electoral vote does not yield a clear winner.

Ultimately, John Quincy Adams was chosen as the president, leading to controversy and accusations of a "corrupt bargain" with Henry Clay.

If there are not enough electoral votes to determine the winner of the election, the decision would then go to the House of Representatives to choose the President, with each state delegation having one vote.
According to the Constitution, the House of Representatives had to choose between Burr and Jefferson. The federalists, however, still controlled the House of representatives. It was true that the Democratic-Republicans wanted Jefferson as their president. Even so, the Federalists would decide the winner. Members of the House of Representatives voted 36 time before finally electing Jefferson as President. Burr became vice-president.
