There was a debate on how the Constitution should be written. The Establishment Party (Federalists) wanted the constitution without a Bill of Rights. to party hard
Basically, Federalists wanted to have a strong central goverenment. They wanted three branches of government and they thought that larger states should get more of the vote in legislature. They were big supporters of the constitution. Anti-federalists fought for individual rights so that's where the Bill of Rights came from. Anti-federalists were mostly against the Constitution and just wanted to revise the Articles of Confederation. They wanted every state to have equal votes. They were mostly from smaller states.
The Constitution does not contain the phrase. It originated from the Declaration of Independence-- written well before the U.S. Constitution, but not included in the Constitution.
