Many, if not all, retailers already have the game stocked for tomorrows release at midnight. Many people who are currently playing the game received a copy early or they themselves work at these retailers and are not going to wait for the release time.
There are also those who have received "burned" copies that are rumored to be passed around for play on hacked Xbox 360s. The PC version is also rumored to have been "burned" to disc.
I came about this information from a person on my Xbox Live friends list who has been playing the game since Thursday and currently owns and manages a video game retail store. He did the same thing with Call of Duty: Modern Warfare 2.
