You have to be level 6 (whether or not you can catch it after level 6 is unknown). It's unknown what needs to be in your garden to attract it, if anything, but it has to be night. When I caught mine, I had a Firebrand and every tree except a Gem Tree. Don't pan around your garden looking for it, or it won't visit your garden. Whack it with your shovel when it enters to catch it.
