Hello, A typical horse fence is four feet tall. A split rail will not do they job. I suggest you go to your local hardware store and buy a 4 foot fence or talk to the people working there about people who you can pay to make a appropriate fence. your welcome
Yes, depending on how deep the pool is and how tall it is. Call your city before purchasing a pool. We bought our kids a 3.5 foot pool to find out we weren't aloud to have one without a fence.
