I believe that it is illegal. The horses are federally protected. There are hundreds of mustangs held in holding pens ready for adoption so there is no need to capture one.
There is a Secret Achievment in Red Dead Redemption called 'Choo Choo Pony'. the get this achievment you have to capture 100 wild horses and get them hit by a moving train. The reward for this achievment is full Honor and fame as well as a horse mounted Maxim machine gun

They are special horses that you have to TAME before you can train and BLUP. After that you can train them like a normal horse. They also give you diamonds until they turn 80 years old. :)

You can get horses almost anywhere. Like if you go to non-main isles you can capture wild horses, you can also get some at the barn/livery, and at the auction house. You can get supplies at the tack store.

Younger horses are of course more wild, when they are first born. For the first couple of months, (before you can begin training them) They are considered domesticated and wild. I know that may seem confusing, but until you train a horse, it is considered wild. Now, you may have an old, not trained horse, just because it is old, doesn't mean it is not wild. It is wild unless you have trained it!
