This is unusual for a cat, as they tend to choose one location, far from where they sleep, and concentrate there (for indoor cats). There are psychological, behavioral and physiological reasons your cat might do this -- some idiosyncratic and minor; some grave. Without more data it's impossible to answer this here. I suggest you phone your vet and ask. Expect that she'll recommend a visit.
There is something very wrong, I don't know the age of this kitten or what sex it is or what it is eating. All these things could play a role in whatever is going on. But no cat or kitten wants to be sitting, laying, or standing in their litter box without a direct reason for it. This kitten would not be laying down in his litter box unless it had no choice in the matter. Either it's hind legs will not hold, and balance him up while he takes care of business, or it is another issue with it's back, having the same problem. This is all just giving you the basic information that a kitten wouldn't do what yours is intentionly. I'm suggesting in the strongest terms that you contact your vet. and have this kitten checked out. It could be any number of things, most needing the attention of a vet. This is important, what you do now will effect this animal for the rest of it's life. Call your vet and tell them what is happening so they can prepare for your appt. This sounds like the kitten may have a bladder problem. Crying while using the litter tray usually means Cystitis (inflammation of the bladder), or some other bladder problem. This needs to be checked out by a vet immediately.
Other symptoms are: Passing small amounts of urine at a time, blood in the urine, trying/straining to urinate but producing nothing and crying. Sometimes a cat will tend to urinate somewhere else in the house instead of their litterbox as they associate the litter box with pain.
This condition, much like human bladder infections, is very painful for the kitten and in some cases (such as a blockage) can be life-threatening if not treated.
Cats usually develop urinary problems from stress or not drinking enough water and the urine becomes too concentrated. This can occur if the cat is fed only dry food (a cat has evolved to get moisture from its food and so have a low "thirst drive") or overly stressed.
The most important treatment, aside from vet-prescribed pain killers (and antibiotics if an infection is present), is to increase your cat's water intake. Feeding wet food instead of dry, adding a little extra water to the wet food and/or providing a water fountain to entice the cat to drink more water are very good options. Even adding "flavoured water" such as juice from canned fish to food or water will help entice a cat to drink.
Also, as cystitis is also thought to be linked to stress, preventing stressful scenarios for your cat will help.
it might be not house trained....... for my cat i would see my cat doing it and i would pick him up and put him in the litterbox and over a little while he got the idea....... or for my other cat i used treats.......

I'm not a kitten expert, but, having multiple answers is If your kitten only just adopted their starvation-like habits, he/she might have a cold! Kittens tend to not eat when they're a little under the weather.
