There is a rubber seal in the spout if it is missing or worn out you may have to replace to find out you may have to unthread the handle on the part where you lift up and the rest will slide out.
If your bath spout leaks when your water is off, then you may have a damaged seal. You can replace all components of the fixture to ensure you've replaced the correct seal.

I usually fit spout 6-8 inches above tub.
That depends on the volume/size of the tub in question. A "tub" could be a butter tub, a mash tub a bath-tub etc.
