No. It is against all merchant agreements to sub-charge their merchant rate. They CAN, however, offer a "cash discount" of 3%(in theory, they would just mark up everything they sell by 3%, and with the cash discount of 3% it would bring it back to regular), and when you pay with a Visa or whichever credit card, include a "cash discount loss". That is the only workaround they can do; still is not ethical though.
