That would depend on both where the event happened and what specifically "went wrong." If you were injured, then you would probably have a legitimate case to file a lawsuit. If the piercing just doesn't look quite the way you wanted it to, then since you didn't pay for it you most likely don't have standing to sue because you haven't been harmed (especially if the person who did this doesn't advertise that they perform this service professionally).
ADDED: Also, keep in mind, most reputable tatoo establishments require you to sign a release before they work on you. Check your local licensing authority for the applicable laws and refer to your copy of the release, (if you received one).

If it hangs or dangles chances are good that it will retain a piercing. Placing the navel piercing off to the side will be problematic for aftercare and irritation during the healing process. If you haven't had a navel piercing before then stay with something that is simpler to care for and will give a result a navel piercing is supposed to give.

Well with no jewellery in it and it not being cleaned out on a regular basis, something has gotten into the actual piercing and is causing irritation to the piercing. Wash the piercing with warm running water and soap give it a good rinse and the irritation should cease.
