Read your governing documents to verify the line where your private, individual ownership stops and the common area or limited common area begins.

'Interior dirt roads' implies the interior of the gated community. It may be that access is over limited common area or common area, and not your 'private' property.

However, if the only way to repair 'interior dirt roads' is across 'your property', the board may be required to give you notice and request permission -- which you may not be able to reasonably deny -- in order to facilitate the repairs.

Again, you can find these particulars in your governing documents.

A homeowners association cannot be a mandatory association without the consent of 100% of the property owners in the development attempting to establish an association. I would like to find out how I can have my property exempted from our local property owners association?

If you purchased your property subject to the by-laws and rules & regulations of a Homeowner's Association you cannot remove your property from the association. All the other owners have the right to expect that each owner must follow the rules and pay their share in the assessments and maintenance fees. Removing your property from the association would mean that you could not share in any of the benefits of the association, including amenities, roadways, common area parking, trash removal, sewer service, master insurance coverage and so forth. There would be no way to accommodate your property separately from the common elements owned by all owners. As an alternative, you can remove yourself from the association by selling your property to a new owner.

Can the home owners association refuse owners gate access codes?

Work with your board and your association manager to most fully understand why access is being denied. For example: It is possible that your governing documents specify that when you do not pay your assessments -- which pays for upkeep of the pool -- that you can be denied access to the pool by refusing to give you gate access codes.

Can property owners be landlocked in Alabama?

Yes they can. If a property owner deeds a parcel of land, he does not have to grant access to the property if the access runs through his own property. I have personally seen a home in McCalla Alabama that had such a problem.

Who assesses condominium owners?

Condominiums are corporations that operate living quarters, the shared exteriors and amenities for which are owned by all members of the condominium association. (The interior of the living units are owned individually). In order to operate the condominium property, individual unit owners pay monthly assessments to the association. The association uses these assessments to pay its bills, including insurance premiums, landscaping and property management services -- and more if the property has other amenities (pool, golf course, etc.), and to make a monthly contribution to reserves, which the association uses to pay to replace real estate assets at the end of the asset's useful life. The association is led by a board of directors. Part of their job is to develop an annual budget and collect assessments from every owner so that the expenses based on the budget can be paid.
