For example, a surgeon is expected to be alert and attentive while performing surgery, and breaches that duty of care if she preforms surgery while suffering a hangover. Similarly, an attorney is expected to provide best efforts to argue the client's case and breached that duty of care if he does less than his best because he would gain if his client looses.
