The police can search trash only if a person does not have a reasonable expectation that it is private.
The police can’t search the following types of trash unless they have a warrant or probable cause:
Trash inside a home
Trash outside of a home
Trash in a person’s pockets or bags
Trash in the back of a car
You have a right to protect your property within your home’s boundaries, even if you throw it away as trash. If the police desire to search your trash can, whether it is inside or outside your home, they must need probable cause or a warrant to do so. They can’t simply drive up to your home, open the trash bin you keep at the side of your property, and search it for evidence in an attempt to charge you with a crime or secure a conviction.
If it is on your property (i.e.: backyard, etc) yes, they do.
However once you "throw it away" and transport it somewhere to be disposed of or picked up, the law considers it to be 'voluntarily discarded property,' and it is fair game for ANYONE to search through it.
No. Trash/garbage that has been set out for collection is considered to be 'abandoned.'

Trash cans are considered to be private property and not subject to a warrantless search until they are placed at the curb for pickup. Once that happens, the police can search the trash cans and seize anything they find.
In Korea there are recycling bins in every house or apartment and they sort their rubbish. And the person comes to collect the rubbish and recycle it. With the food trash they feed it to worms.

I have two type of trash can in my home (Recyclable trash & Toxic/Hazardous trash can). This will help me to separate my house waste. I have contract with my local trash collector they used come once a week and collect my trash frequently. Throwing the trash can in the street would create lot of problems for the surroundings as well as for our self. Better keep deal with the local waste collectors ( try www.trashinme.com ) in your area.
