Most state's have begun (or require) a non-smiling picture on the license because the drivers licenses images are scanned into a separate facial recognition data base and can be retreived at a later date for use in a facial recognition identification system. ALSO: under most circumstances when you are required to produce a drivers license you are generally not in a "smiley" situation.
Some states are trying to make it against the law. It isn't against the law yet though. I smiled for mine!
