Yes. The child support division may divert the entire amount of a tax refund to pay towards any back child support. The IRS doesn't care about other children or other obligations. The only way to prevent this is file for a modification of the support order in court and provide compelling reasons why the entire tax refund check should not be diverted to pay down child support arrears.

This will continue until all amount in arrears is satisfied and after that time, it is your responsibility to ask that the state that intercepted your tax returns do a tax offset review. Be prepared to provide all documents that show you have paid and are current, then they may dismiss the lien against you. You may be entitled to a refund from that state if your tax refund continues to be diverted after the arrears has been satisfied.

How much does your gross income have to be to get the child's tax credit and does unemployment count as gross income?

The Child Tax Credit is $1,000 for each of your dependent children that you are claiming that are 16 or younger. It doesn't have anything to do with gross income. This credit is nonrefundable, so it can only reduce your tax to zero. If your tax is less than this credit (see worksheet in IRS instructions), you will only claim enough of the credit to reduce your tax to zero & you may qualify for the Additional Child Tax Credit. The Additional Child Tax Credit is refundable (you can get money back if it's more than your taxes). It can be affected by your income. If the Child Tax Credit worksheet directs you to this credit, use IRS Form 8812 & instructions to see how much to claim. The total claimed on the line for Child Tax Credit & Additional Child Tax Credit cannot be more than $1,000 for each dependent child age 16 or younger. Yes, unemployment is part of gross income. However, it is not earned income.

Can you deduct more than 5000 of child care off your taxes?

You figure your child/dependent care credit on up to $3,000 actual expenses for one child/dependent or up to $6,000 actual expenses for two or more children/dependents. Form 2441 is Child and Dependent Care Expenses. The amount of the credit is entered on line 48 (Credit for Child and Dependent Care Expenses) of Form 1040 or on line 29 of Form 1040A. For more information, go to www.irs.gov/taxtopics for Topic 503 (Child and Dependent Care Expenses). Also go to www.irs.gov/formspubs for Publication 503 (Child and Dependent Care Expenses).

Can a handicapped child not living at home be a dependent?

If the parents are paying over a certain percentage of the expenses, believe the child could still be declared as dependent. Strange as it sounds...probably not a qualifying child...but presuming you meet the income and support tests...they may be a qualifying relative. And they may well qualify for dependent care credit (not the same as a dependency deduction).
